2. Petitioner seeks regular bail in connection with Lalganj P.S. Case No. 373 of 2022 dated 11.10.2022 registered for the offences punishable under Sections 341, 323 and 302 read with Section 34 of the Indian Penal Code.

3. Learned counsel appearing for the petitioner submits that initially in respect of the death of the deceased, an U.D. Case No. 02/2022 was lodged on the basis of the application filed by the nephew of the deceased in which simple allegation of quarrel being taken place between the deceased and her one neighbour was made but no allegation was levelled against this petitioner in that petition and the petitioner is not a neighbour of the deceased. Patna High Court CR. MISC. No.68632 of 2024(2) dt.20-09-2024 2/2 described in the petition of the U.D. Case took place on 16.03.2022 but later on, after more than six months, a police case was lodged against this petitioner on the basis of an application filed by one Amresh Kumar Pandey, A.S.I. posted at Lalganj police station. As per the postmortem report, the immediate cause of the death of the deceased was due to cardiopulmonary arrest which is not corroborating the allegation levelled against the petitioner. Learned counsel further submits that the petitioner has been languishing in jail since 12.10.2022 and has fair and clean antecedent.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the above submissions and mainly taking into account the petitioner's custody period and his fair and clean antecedent, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Lalganj P.S. Case No. 373 of 2022.
