The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
Accusation is of robbing the pick-up van of the informant by miscreants leading to registration of FIR against co-accused Akhilesh Bhai and four others. The name of petitioner sprang up on confession of co-accused Binod Chaudhary.
It is submitted by learned counsel for the petitioner that neither there is any recovery from the petitioner nor there is any material against the petitioner and the co-accused Binod Chaudhary, who named the petitioner and other similarly
Patna High Court Cr.Misc. No.31632 of 2015 (2) dt.06-08-2015 2/2 situated co-accused have been granted regular bail vide Criminal Miscellaneous Nos. 10518 and 12138 of 2015. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts may constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Jandaha P.S. Case No.205 of 2014, pending before the learned Chief Judicial Magistrate, Vaishali at Hajipur.
With the above observation, this application is, accordingly, disposed off.
