JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 23-12-2016 Heard the counsel for the petitioner and the State. The petitioner is the victim of Karakat P.S. Case No. 114 of 2016, lodged by her father under Section 366A/34 of the IPC. The matter is still under investigation. The petitioner wants protection from the State.

I am afraid a victim of the offence has no reason to suspect her arrest in the case. Any observation made on the writ petition would probably affect the investigation which is still going on pursuant to the lodgment of the case. Counsel for the petitioner submits that the petitioner would appear before the

Patna High Court Cr. WJC No.1240 of 2016 (2) dt.23-12-2016 Superintendent of Police, Rohtas with a request to take steps for recording her statement under Section 164 of the Cr. P.C. in order to bring to the fore the truth. It is yet another matter which the investigating authority or the superior police authority has to consider/examine and take steps as per law.
