JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 The petitioners are apprehending their arrest in connection with Ekanger Sarai P.S. Case No. 70 of 2015 for the offence under Sections 341, 323, 307, 504/34 of the Indian Penal Code.
Heard learned counsel for the petitioners and the State.
The prosecution story, in brief, is that when the informant was at his residence, the petitioners along with other co-accused persons came and started abusing the informant and his family and on protest both the petitioners started assaulting by iron rod.
It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case and counter case. The petitioners'' side have also sustained injury
Patna High Court Cr.Misc. No.30657 of 2015 (2) dt.30-07-2015 which has not been explained by the prosecution. The injury of informant is said to be simple in nature.
On behalf of the State, it has been submitted that the petitioners are named in the First Information Report. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Hilsa, Nalanda in connection with Ekanger Sarai P.S. Case No. 70 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
