Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 of the Indian Penal Code.

The prosecution case is that the petitioner restrained the informant and his family members to use of different path way. On protest being made, the petitioner assaulted on the head of the informant. When Puja Devi, daughter-in-law of the informant came to rescue, then she was also being assaulted by lathi.

It is submitted by the learned counsel for the petitioner that injuries have been found to be superficial simple in nature and for petty dispute the accusation has been levelled. Statement has been made in para-3 of the petition that

Patna High Court Cr.Misc. No.1698 of 2016 (2) dt.13-01-2016 petitioner has no criminal antecedent.

Considering the genesis of the occurrence and the nature of injury, this is a case for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Devkund P.S. Case No. 15 of 2015, pending in the court of learned Chief Judicial Magistrate, Aurangabad. With the above observation this application is disposed of.
