2. The petitioners seek bail, who are in custody since 05.05.2022 in connection with Kochadhaman P.S. Case No. 111 of 2022 corresponding to Sessions Case No.251 of 2022, F.I.R. dated 03.05.2022 registered for the offence punishable under Sections 302,304(B),120(B)/34 of the Indian Penal Code.
3. Allegation against the petitioners is that they alongwith other co-accused persons have in furtherance of their common intention committed the dowry death of the daughter of the informant.
4. Learned counsel appearing for the petitioners submits that the petitioners have clean antecedent and they have
Patna High Court CR. MISC. No.65753 of 2022(5) dt.17-07-2023 2/2 falsely been implicated in the present case. Further submits that the allegation as alleged in the FIR is false and fabricated and the petitioners are inlaws of the deceased.
5. Vide order dated 08.05.2023, a report was called for with regard to the stage of the trial. Report of the learned Trial Court dated 15.05.2023 reveals that out of seven witnesses, five witnesses have already been examined and the case is pending for examination of the rest of two prosecution witnesses.
6. Considering the report of the learned Trial Court, I am not inclined to enlarge the petitioners on bail in connection with Kochadhaman P.S. Case No. 111 of 2022 corresponding to Sessions Case No.251 of 2022 pending in the court of learned District and Sessions Judge, Kishanganj.
7. Prayer is refused.
8. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
