The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 307, 354, 504, 34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that all the accused persons were abusing Ruma Devi, wife of the informant when informant made protest he was assaulted and abused by calling caste name. It is submitted by learned counsel for the petitioners that for a petty dispute the accusation has been levelled and the F.I.R. was registered on 16.04.2015 but it reached to the court of
Patna High Court Cr.Misc. No.33348 of 2015 (2) dt.12-08-2015 2/2 learned Chief Judicial Magistrate on 18.04.2015 which clouds bona fide of the accusation. Moreover, no injury report is on record. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with SC/ST Dehri P.S. Case No.11 of 2015, pending before the learned Chief Judicial Magistrate, Rohtas at Sasaram.
With the above observation, this application is, accordingly, disposed off.
