The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506 and 379/34 of the Indian Penal Code.
It is alleged against petitioner no. 2 Ram Naresh Sah that he assaulted the informant with lathi on his right thigh, left leg and shoulder and thereafter assaulted with Garasi on the head and took out Rs.20,000/- from the pocket of the informant when the wife of the informant came to save then petitioner no. 2 assaulted the wife of the informant with Garasi
Patna High Court Cr.Misc. No.33308 of 2015 (2) dt.11-08-2015 2/2 on her head.
It is submitted by learned counsel for the petitioners that though incised wounds have been found on the heads of the informant and his wife but the same have been found to be simple. There is a counter version of the occurrence and petitioners' side have also received injuries. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Riga P.S. Case No. 105 of 2015 pending in the court of learned Chief Judicial Magistrate, Sitamarhi.
With the aforesaid observation, this application is disposed of.
