The petitioners apprehend their arrest in connection with Chanan P. S. Case No. 16 of 2017 instituted under Sections 307, 323, 337, 341, 504 and 379/34 of the Indian Penal Code. The allegation, in brief, is that accused persons were making attempt to construct the house and the informant when objected, Sintu Paswan and another accused started assaulting with feast and slaps and when her husband turned up then one Sindhu Kumar hit him with piece of a brick over the head of the informant's husband and Nisha Kumari snatched away mobile. Learned counsel for the petitioners submits that due to land dispute, these petitioners have been falsely implicated and there is no allegation of assault done by these petitioners. Infact,
Patna High Court Cr.Misc. No.38948 of 2017 (2) dt.19-08-2017 2/2 there is no any specific allegation against these petitioners except an ornamental allegation of snatching away mobile against petitioner no. 1 and the petitioners are ladies having no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Nisha Kumari and Pyari Devi, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Chanan P.S.Case No. 16 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
