JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 448 and 504 of the Indian Penal Code. The prosecution case is that the petitioner Ram Gulam Paswan assaulted with fodder cutter causing injury on the head of the informant when co-accused Indrajit Paswan assaulted with khanti causing injury on the wrist of the left hand of the informant and when the brothers of informant Sanjay Mahto and Dina Mahto came to rescue, co-accused Amarjeet Paswan and Sujeet Paswan assaulted with danda. It is further alleged that co-accused Akhilesh Paswan and Parmila Devi assaulted the wife of Sanjay Mahto. It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.6968 of 2016 (2) dt.16-02-2016 2/2 only the informant and his brother Dina Mahto received simple injuries. Neither Sanjay Mahto nor the wife of the informant received any injury. Injury of the informant has been found to be simple caused by hard and blunt substance when the petitioner is alleged to have caused injury with sharp cutting weapon. There is counter version of the occurrence also and petitioner's side also received injury. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sheikhpura in connection with Barbigha P.S.
