The petitioner seeks bail in a case registered for the offence under Sections 302, 120B of the Indian Penal Code. As per the prosecution case, the informant received information that his son was lying unconscious on the road, who is said to have sustained single injury on his head and the informant suspects that the person, who was threatening his son on mobile, might have killed his son.
Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of the investigation only on suspicion. Only material, which has come against the petitioner, is that this petitioner was seen near the place of occurrence on the alleged date and time. Save & except this, there is no other substantial evidence against this petitioner. One
Patna High Court CR. MISC. No.1231 of 2022(3) dt.29-03-2022 2/2 co-accused Kanchan Kumar @ Kanchy has already been granted bail by a coordinate Bench of this Court and petitioner is in custody since 12.08.2021, having no criminal antecedent. Investigation is complete.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Birpur, District - Supaul in connection with Raghopur P.S.
