The petitioner seeks bail in a case for the offence registered under Sections 406, 420, 409, 467 and 468/34 of the IPC.

The prosecution story, in brief, is that the informant who is the Anchal Officer, Piprasi, through his written letter to Officer-in-charge, Dhanha, in which he stated that the petitioner committed irregularities in the Solar Light Scheme and therefore, they violate the rules, thereunder so an F.I.R. be lodged in Panchayati Raj Act. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 04.08.2019. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. Allegation of misappropriation of fund in respect of installation of solar lights in the Panchayat was made against the petitioner who is said to be the Mukhiya. It is submitted that Rs. 3,92,000/- has already been deposited in the account of Panchayat. It is further submitted that the petitioner is ready to deposit an amount of Rs. 50,000/- (Rupees Fifty Thousand) only in the learned court below which shall be subject to final disposal of the case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs. 50,000/- (Rupees Fifty Thousand) only in the learned court below which shall be subject to final disposal of the case. On doing so, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M.,
