JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 14-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and Section 27 of Arms Act.
As per the allegation in F.I.R., allegation against the petitioner and his brother is that they assaulted the informant with knife and iron rod, as a result of which informant sustained injuries.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.1550 of 2022(4) dt.14-11-2022 2/2 petitioner that in the background of some land dispute, the present F.I.R has been registered. It is also submitted that neither the alleged knife or iron rod recovered from the conscious possession of the petitioner nor there is any eye witness of the incident.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 6th, Ara in connection with Sahar P.S. Case No. 163 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
