The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 394/411, 414 and 201 of the Indian Penal Code. The prosecution case is that a robbed loaded truck was found parked near the courtyard (Dalan) of the petitioner.
It is submitted by learned counsel for the petitioner that even assuming the accusation recovery cannot be treated from the petitioner's possession as it was found parked near the house of the petitioner which do not suggest the complicity of the petitioner in the crime. Moreover, seizure list
Patna High Court Cr.Misc. No.6382 of 2016 (2) dt.10-02-2016 2/2 also not bears the signature of the petitioner or his family members.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kurhani P.S. Case No. 96 of 2014 pending in the court of learned Judicial Magistrate, Ist Class, Muzaffarpur.
With the aforesaid observation, this application is disposed of.
