JUSTICE SANJAY KUMAR ORAL ORDER 22-08-2017 Heard learned counsel for the petitioner and learned counsel for the State and perused the records. The petitioner apprehends arrest in connection with Muffasil Police Station Case No. 81 of 2017 registered for the offence punishable under section 414 of the Indian Penal Code and section 25 (1) of the Antiquity Act.

It has been submitted that the petitioner has neither any criminal antecedent nor any incriminating material has been recovered from his possession. The name of this petitioner surfaced in the statement of co-accused Ghantu Mahto, who was apprehended by the Police near hilly area of Sita Kund Dih with idol of Lord Mahavir, which was brought by him for the purpose of sale. The allegation of his involvement in selling idol is vague

Considering the nature of allegation, facts and circumstances, as stated above, this application for anticipatory bail is allowed and it is directed that the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Munger in connection with Muffasil Police Station Case No. 81 of 2017, subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code.
