JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Bidupur P. S. Case No.317 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 02.09.2021, charge-sheet has been submitted in the case and has antecedent of three cases. The learned counsel for the petitioner submits that he has filed a supplementary affidavit bringing on record the criminal antecedent of the petitioner as in the bail application at Para-3 only one criminal antecedent was mentioned. Allegation is of recovery of 1830.60 litre of liquor from a pick-up vehicle.

Patna High Court CR. MISC. No.1620 of 2022(2) dt.04-03-2022 2/2 It is submitted that petitioner was not arrested from the spot. Learned counsel submits that since he has antecedent of three cases and as such, his name was falsely implicated in the present case.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Act, Vaishali at Hajipur in connection with Bidupur P. S. Case No.317 of 2021.

The application stands allowed.
