Petitioner in the present case is seeking a direction in the nature of writ of Mandamus commanding the respondents to conduct a proper investigation of this case by competent agency as according to the petitioner the police authorities have not conducted proper investigation of the case and have misdirected the course of investigation.
Learned counsel for the petitioner submits that the
Patna High Court CR. WJC No.1465 of 2022(2) dt.20-12-2022 2/2 investigation of this case is complete and police has submitted a report under Section 173(2) Cr.P.C. but the said report does not contain investigation from different angles. Learned counsel submits that the petitioner is looking for further investigation of the case.
Learned counsel for the State is present and has opposed this application.
Considering the facts and circumstances of the case wherein, at this stage, the investigation of the case has already been done by the police authorities but the petitioner is looking for further investigation, in the opinion of this Court, the petitioner may submit a proper application in the court below itself under Section 173(8) Cr.P.C. and/or before competent police authorities seeking further investigation if so advised. With the aforesaid liberty to the petitioner, this writ application is disposed of.
