Mr. Anuj Kumar Shrivastava, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 10-09-2025 Heard Mr. Ravi Shankar Sahay, learned counsel for the petitioners and Mr. Anuj Kumar Shrivastava, learned APP for the State.

2. Petitioners seek regular bail in connection with Baddi P.S. Case No. 89 of 2025 dated 22.05.2025 registered for the offences punishable under sections 126(2), 127(2), 351(2), 309(4) and 3(5) of the Bharatiya Nyaya Sanhita and section 27 of the Arms Act.

The main submissions advanced by petitioners' counsel are that the instant matter relates to the loot of a mobile phone from the possession of the informant and the name of the petitioners came into light in the confessional statement of coaccused Umesh Ram. Though as per the prosecution, the looted mobile phone is said to have been recovered from the

No.64157 of 2025(2) dt.10-09-2025 2/2 possession of the petitioner No. 1 but the same is alleged to have been given to him by co-accused Umesh Ram and against the petitioner No. 2, there is no evidence to connect him to the alleged crime. It is further submitted that the petitioners bear no criminal antecedent and have been languishing in jail since 24.05.2025 and against them, the investigation has been completed.

4. Learned APP for the State has opposed the prayer of the petitioners.

In the facts and circumstances of this case and considering the aforesaid submissions, mainly the petitioners' fair and clean antecedent and completion of investigation against them, this Court is inclined to release them on bail. Accordingly, let both the petitioners named-above be released on bail on furnishing bail bonds of Rs. 20,000/-(Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the court concerned in connection with Baddi P.S. Case No. 89 of 2025.
