The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30 (a) and (d) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on an information having been received, a raid was conducted in the house of the petitioner. Various utensils for manufacture of liquor and 8 litres of country liquor was recovered from the petitioner's house. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession or his house. The cause of his false implication is his antecedents. He is in custody since 7.11.2021.

Having heard learned counsel for the parties and taking into consideration the recovery of 8 litres of country liquor together with other articles/utensils used for manufacture of liquor as also the antecedent of the petitioner under the Bihar Prohibition and Excise Act, 2016, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Liberty is granted to the petitioner to renew his prayer for bail on completing one year in custody.
