====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2018.

As per prosecution case, 15 liters of illicit liquor has been recovered from outside the village.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Name of the petitioner transpired during the course of investigation. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the

Patna High Court CR. MISC. No.65962 of 2022(2) dt.16-12-2022 2/2 above named petitioner in the event of his arrest/surrender before the Court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge Excise, Court No. II, Muzaffarpur, in connection with Excise P.S. Case No. 42 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
