This is a case registered under Section 392 of the Indian Penal Code.
Allegation in the FIR is that while the informant was returning from the shop he was stopped by the four persons and they had snatched his belongings.
Counsel for the petitioner submits that from perusal of the FIR it is quite obvious that no allegation of snatching of any articles is attributed against the petitioner. He further submits that the instant case has been lodged as the informant and his staff was on inimical terms with the petitioner. Subsequently the informant has filed compromise petition before the Trial Court to compromise the issue. He also submits that though prior to the
Patna High Court Cr.Misc. No.39258 of 2017 (2) dt.19-08-2017 2/2 instant case there is one other case pending against the petitioner which has been disclosed in para 3, but in that case he is on bail. He is in custody since 21.06.2017 in connection with instant case. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 122 of 2017.
