The petitioner has prayed for bail in a case registered for the offence punishable under sections 419, 420 and 379 of the Indian Penal Code and section 66(c) of I.T. Act. As per allegation in the FIR, informant is user of credit card and a fraud call has been received by his kids in his absence, who have provided all the secret information to the caller. It is further alleged that accused Dharmendra Kumar has withdrawn an amount of Rs. 97,940 by using his SBI credit card without his knowledge and he has transferred it in the account of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The

Petitioner has returned the said money to the informant and both parties have compromised the matter, and petitioner has annexed the compromise petition as Annexure-2 to the petition. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 20.10.2022 passed in Cr. Misc. No. 56320 of 2022. Petitioner is languishing in judicial custody since 15.08.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jamui in connection with Sono P.S. Case No. 265 of 2021.
