The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 328, 307 and 379/411 of the Indian Penal Code.

It is alleged that while travelling in train the informant was administered some intoxicant material through water and his belongings were taken away. During investigation, co-accused Rajeshwar Kumar was apprehended and from whose possession mobile of the informant was recovered. He confessed that he purchased the recovered mobile from the petitioner.

No.35866 of 2015 (2) dt.04-09-2015 2/2 Considering the fact that investigation has concluded and the charge-sheet has already been submitted, let the learned court below consider the prayer for regular bail of the petitioner keeping in view the fact that Rajeshwar Kumar on whose confession the name of the petitioner has been figured, has been granted bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with (Rail Samastipur) SPJ, Rail P. S. Case No. 65 of 2013, pending in the court of learned Railway Judicial Magistrate, Samastipur.

With the aforesaid observation, this application is disposed of.
