JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-01-2025 Heard Mr. Dhananjay Kumar, learned counsel for the petitioner, informant and Mr. Dilip Kumar No. 1, learned Additional Public Prosecutor for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 323, 341, 307, 328, 498A, 504/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act. Subsequently, Section 304B of the IPC has been added.
3. Earlier prayer for bail of the petitioner was rejected on 25.01.2024 passed in Cr. Misc. No. 27817 of 2023.
4. Petitioner along with other accused persons are said to have committed murder of the sister of the informant.
5. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that charge has been framed against the petitioner and there is no allegation against him to tamper with
Patna High Court CR. MISC. No.66929 of 2024(6) dt.21-01-2025 2/2 the prosecution witnesses. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 27.09.2022.
6. Learned APP for the State and informant oppose the prayer for bail.
7. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Beur P.S. Case No. 479 of 2022.
8. However, petitioner is at liberty to renew his prayer for bail after examination of the informant. (Anjani Kumar Sharan, J) devendra/- U T
