ANJANA MISHRA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Sakra P.S. Case No.511/13 for the offence under Sections 302 and 201 of the I.P.C.

Earlier the case diary which was called for has now since been received in the present case.

Learned counsel for the petitioner submits that an out and out allegation has been made against the petitioner only on the basis of conjecture and surmises. He further submits that final form has been submitted showing as mistake of fact in the present case.

Considering the peculiar nature of case and also the

No.37058 of 2015 (3) dt.21-12-2015 2/2 petitioner has no criminal history, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Muzaffarpur, in Sakra P.S. Case No.511/13 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
