This application for anticipatory bail arises out of Akilpur P.S.Case N0. 42 of 2016, disclosing offences under Section 37 of the Essential Commodities Act.

Learned counsel appearing on behalf of the petitioner has submitted that with similar allegation the First Information Report lodged against six persons including this petitioner, one of them Raj Kumar alias Raju Kumar has been allowed anticipatory bail by this Court by order, dated 14.07.2017, passed in Criminal Misc. No. 32485 of 2017.

On perusal of the First Information Report, I am of the view that the case of the petitioner cannot be distinguished from the case in which this court has granted anticipatory bail.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Danapur in Akilpur P.S. Case No. 42 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
