ANJANA MISHRA ORAL ORDER 25-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 25.02.2019 in connection with N.D.P.S. Case No.17 of 2019 arising out of Sherghaty P.S. Case No.65 of 2019 registered for the offence under Section 20/22 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the alleged recovery is of 8 Kgs. Ganja from the hotel room which was booked by the petitioner. Learned counsel further submits that actually such recovery is not from his conscious possession. It is further submitted that in any view of the matter, the amount is less than the commercial quantity and the petitioner has remained in jail for nine months and,

Having considered the entire facts and circumstances and that there is no representation on behalf of the Union of India, which has been served with a copy earlier, and the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge Cum Special Judge (N.D.P.S. Act), Gaya, in connection with N.D.P.S. Case No.17 of 2019 arising out of Sherghaty P.S. Case No.65 of 2019.
