The present writ application has been filed for a direction to the respondent authorities, specially, respondent no. 3, the Circle Officer, Simri, Buxar to allow the road to be constructed as per the demarcation made in pursuance to Demarcation Case No. 25 of 2010-11.
A counter affidavit has been filed on behalf of respondent nos. 2 and 3 with specific averments in paragraphs 6 to 8 that the road has been constructed only on Plot No. 1039 on which the road was existing from before after due measurement. However, learned counsel for the petitioner submits that, maliciously, the raiyati land of the petitioner has also been encroached for the purposes of constructing road. Since the stand taken by the respondents has not been controverted by learned counsel for the petitioner, hence, this writ application has become infructuous.
