The petitioner seeks bail in a case registered for the offence under Sections 399, 402 of the I.P.C. and Sections 25(1b)a, 26, 35 of the Arms Act. One loaded country-made pistol, one live cartridge and some cash have been recovered from the possession of the petitioner.

It is submitted on behalf of petitioner that no incriminating article has been recovered from the conscious possession of the petitioner and he has been implicated in this case only on suspicion. Petitioner is in custody since 08.09.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Samastipur in connection with Samastipur Mufassil P.S. Case No. 369 of 2021.
