2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 401, 411, 120B of the Indian Penal Code and Sections 20(B)II(C), 25, 29, 8 of the NDPS Act.

3. The case of prosecution is that the petitioner along with other co-accused persons were apprehended on spot by police party. Upon search, some golden ornaments were recovered from possession of this petitioner and Ganja like substance as well as other materials were recovered from possession of co-accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has

Patna High Court CR. MISC. No.65843 of 2023(4) dt.02-02-2024 2/2 falsely been implicated in this case. The alleged recovery of ganja were not recovered from possession of this petitioner. Only some ornaments have been recovered from possession of this petitioner but the same were not put on TIP. The petitioner is a lady and she has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 10.8.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the facts and circumstances of the case as well as the petitioner is a lady and her custody period, this court is inclined to enlarge her on bail. The above named petitioner is directed to be released on bail in connection with Dalsinghsarai P.S. Case No. 329 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Samastipur.
