JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 578C of 2018, disclosing offences under Sections 323, 324, 354, 504, 498(A) of the Indian Penal Code and Section 3 /4 of the Dowry Prohibition Act.

Petitioner happens to be husband of the complainant and allegation against him is of subjecting the complainant for non fulfillment of demand of motorcycle as dowry and of ousting from matrimonial house.

Submission of learned counsel for the petitioner is that he is still ready to keep her with full honour and dignity and

Heard learned A.P.P. also It appears from perusal of the impugned order that on notice complainant has appeared before the learned Sessions Judge, Munger, and expressed her desire to live with the petitioner but the petitioner did not appear a such the steps for mediation between the parties failed, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner, if so desire may approach the complainant and persuade her to live with him and, thereafter, surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will consider the same and will pass an appropriate order on the regular bail application of the petitioner.
