2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 109, 76, 303(2), 352 and 351(2) of the B.N.S.

3. As per the F.I.R., the allegation against the petitioner is that he assaulted on the head of the informant with spade which caused him injury.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Doctor has found the injury simple in nature. He further submits that that there is case and counter-case between the parties. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed

Considering the nature of injuries, clean antecedent and the fact that there is case and counter-case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Sarbahada P.S. Case No. 69 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
