====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2024 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 379, 387, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, when the informant was constructing his boundary wall, accused persons came there and assaulted him and co-accused Kanhaiya took Rs.10,000/- from the pocket of the informant.

4. Learned counsel appearing for the petitioner submits that parties are agnate and there is land dispute between them for which section 144 Cr.P.C. was also initiated. There is general and omnibus allegation against this petitioner and no specific overt act has been alleged against him. Petitioner claims clean antecedent. Several co-accused, with similar allegation,

Patna High Court CR. MISC. No.67088 of 2024(2) dt.08-10-2024 2/2 have already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No.63925/2024.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Begusarai Nagar Police Station Case No. 599 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
