JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 420 of the Indian Penal Code and Section 3(1)(x)(xi) of the SC & ST (Prevention of Atrocities) Act.
The prosecution case is that petitioner being teacher in the school realized Rs. 25000/- from the informant for providing employment as a teacher but neither employment was provided nor money was returned and when the informant made protest then she was abused by calling cast name and assaulted by fists and slaps.
It is submitted by learned counsel for the petitioner that there is no proof with regard to the payment. The complaint was filed with inordinate delay and the informant has subsequently retracted from the initial version and has filled a petition to that effect before learned court below.
Patna High Court Cr.Misc. No.41994 of 2015 (2) dt.13-10-2015 2/2 A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Saharsa SC/ST P.S. Case No. 52 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
