The petitioner seeks bail in Barachatti P.S. Case No.381 of 2017 for the offence under Section 272, 273, 120(B) of I.P.C., and Section 30(a), 38 and 47 of the Bihar Prohibition and Excise Act 2016.

Allegation as per the F.I.R. is of recovery of 48 bottles of wine from the motor cycle which was driven by the petitioner. Submission of the learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner rather it was recovered from the possession of coaccused, Binod Kumar Yadav and Yaddu Yadav. He is in custody for 1 1⁄2 months having no criminal antecedent. Heard learned A.P.P. also.

No.39998 of 2017 (2) dt.22-08-2017 2/2 Having heard both sides and in view of the facts and circumstances, as state above, let the petitioner, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya, in Barachatti P.S. Case No.381 of 2017 subject to the conditions that one of the bailors must be of local person having sufficient immovable property within the jurisdiction of the court concerned and he will cooperate in the trial and appear before the court below on each and every date fixed in the trial, failing which his bail bond will be cancelled.
