JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Belaganj P.S. Case No. 201 of 2019 registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code, pending in the court of A.C.J.M.-11th, Gaya. Allegation as per FIR is that the informant, who happens to be uncle of the petitioner, while going to Chennai for eye operation handed over the keys of his house to the petitioner and when returned he found that his ornaments and valuables were missing from the locker of almirah.

Submission of learned counsel for the petitioner is that he has falsely been implicated as there is land dispute between the parties. However, petitioner has not shown any paper relating to land dispute with the informant, whereas impugned order disclosed that the witnesses have supported the

Patna High Court CR. MISC. No.58579 of 2019(2) dt.17-09-2019 2/2 prosecution case and furthermore it appears that earlier also petitioner cheated other persons.

Heard learned APP also.

In view of above facts and circumstances, this is not a fit case for grant of anticipatory bail. Prayer for anticipatory bail is rejected. However, he may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
