JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 149C of 2011 instituted for the offences punishable under Sections 457, 384, 376, 504, 323 and 325 of the Indian Penal Code.

Allegation against the petitioner is of committing rape upon the complainant after entering inside her house and also assaulting her and taken away her belongings and further case is that she was treated by Doctor.

Submission of learned counsel for the petitioner is that she is in habit of filing of such cases and earlier also she has lodged a rape case against another person and furthermore she is 45 years old and petitioner is aged 28 years.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
