JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 21-12-2015 Both these applications have been filed on behalf of the petitioners for modification in the order dated 16.04.2015 passed in Criminal Misc. Nos.41747 of 2014 with Criminal Misc.
Patna High Court Cr.Misc. No.40834 of 2015 (3) dt.21-12-2015 2/3 No.47286 of 2014 passed by this Court with regard to extend the period of surrender of the petitioners of both the Criminal Misc. Applications in the court below. Therefore, both these applications have been heard together and are being disposed of by this common order.
Learned counsel appearing on behalf of the petitioners submits that by the common order dated 16.04.2015 passed in Criminal Misc. No.41747 of 2014 with Criminal Misc. No.47286 of 2014, in the event of their arrest or surrender before the learned court below by the petitioners within a period of four weeks from that day, the petitioners were granted anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Singhwara P.S. Case No.74 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. but the petitioners could not surrender within a period of four weeks as granted by the said order. In that view of the matter, learned counsel for the petitioners prays for extension of period of surrender of the petitioners in the court below.
Considering the submission of the learned counsel for the petitioners, the period of surrender of the petitioners in
Patna High Court Cr.Misc. No.40834 of 2015 (3) dt.21-12-2015 3/3 connection with the aforesaid case in the court below is further extended for four weeks from today and these applications are, accordingly, allowed with the aforesaid modification in the order dated 16.04.2015 passed in Criminal Misc. Nos.41747 of 2014 with Criminal Misc. No.47286 of 2014.
