JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Motihari Town P.S. Case No. 163 of 2019, disclosing offences under Sections 467, 468, 471, 420, 506, 34 of IPC.

Allegation against the petitioner is that by impersonating the informant, he got the sale deed with respect to her land, later on, is trying to grab the land. Submission of the learned counsel for the petitioner is that prior to that a complaint petition has been filed by the petitioner against the informant of this case and F.I.R. has been registered on that basis that in spite of executing the sale deed she is not allowing to construct the boundary over the same and now he has filed supplementary affidavit showing the transfer of money in the account of the informant, as consideration of sale.

Patna High Court CR. MISC. No.61504 of 2019(2) dt.26-09-2019 2/2 Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also and has submitted that by impersonating sale deed executed and the land belongs to the informant. Further submission is that there is case and counter case between the parties.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. East Champaran at Motihari, in connection with Motihari Town P.S. Case No. 163 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in the investigation.
