JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 06-02-2018 Heard Mr. Dhananjay Kumar, learned counsel appearing for the petitioner and Mr. Rakesh Prabhat, learned Assisting Counsel to Standing Counsel No.21 for the State.

The petitioner is aggrieved by the appointment of respondent no.5 as Anganwari Sevika in Gopalpur Centre of Gram PanchayatChiraura under Block- Naubatpur in the district of Patna. The guidelines relating to services of Anganwari Sevika and Sahayika provides for a forum to complain against the selection process and which lies before the District Programme Officer and which remedy has not been exhausted by the petitioner rather she has rushed to this Court directly.

Having heard learned counsel for the parties and considering

Patna High Court CWJC No.4010 of 2016 dt.06-02-2018 the alternative remedy so available to the petitioner under the guidelines this Court while granting leave to the learned counsel for the petitioner to add the District Programme Officer, Patna as party respondent no.6 to the present proceedings during the course of the day, disposes of the writ petition with liberty to the petitioner to raise her grievance before the newly added respondent no.6.

It goes without saying that if any application is filed within a period of 4 weeks from today along with a petition for condonation of delay, the District Programme Officer, Patna would consider and dispose of the same on merits in accordance with law after opportunity of hearing to the petitioner and private respondent no.5 as well as the other concerned parties expeditiously and preferably within a period of 3 months of the expiry of 4 weeks.
