2. The petitioners have prayed for bail in connection with Goraul (Kathara) P.S. Case No. 447 of 2025 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act.
3. The case of the prosecution is that from a bike, altogether 40 liters of country made liquor was recovered.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. They have no concern with the alleged liquor and bike. Nothing has been recovered from their possession. They are in
Patna High Court CR. MISC. No.62881 of 2025(2) dt.22-09-2025 2/2 judicial custody since 31.07.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner no. 1 is having criminal antecedent of three cases and petitioner no. 2 is having criminal antecedent of two cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.1-cum-Additional District and Sessions Judge, Vaishali at Hajipur in connection with Goraul (Kathara) P.S. Case No.447 of 2025 with a condition that petitioners shall not indulge in similar nature of the offence in future.
