JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2017 Heard Sri S.N.P.Sinha, learned Senior Counsel, assisted by Sri Ram Prawesh Kumar, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Sri Ganesh Sharma, learned counsel for the informant.
This is second attempt for grant of bail on behalf of the petitioner. Earlier, considering the case diary, by a detailed order dated 18.04.2016 vide Cr.Misc.No.7178 of 2016 , the prayer for bail of the petitioner was rejected.
Learned Senior Counsel tried to persuade the Court that on merit also, the petitioner deserves to be extended the privilege of bail. He further submits that the petitioner is in custody since 04.10.2015, but trial is not proceeding expeditiously. Primarily again on the ground of merit, learned Senior Counsel for the petitioner tried to persuade the Court to extend the privilege of
Patna High Court Cr.Misc. No.43761 of 2017(2) dt.20-09-2017 2/2 bail to the petitioner, whereas learned Addl. Public Prosecutor as well as Sri Ganesh Sharma, learned counsel for the informant submit that in the case, evidence is going on and till date about four prosecution witnesses have already been examined. Be that as it may, considering the seriousness of accusation as well as the fact that on merit, earlier by a detailed order, the prayer for bail of the petitioner was rejected by this Court, there is no reason to review my earlier order.
The petition stands dismissed.
