JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 354, 504 and 34 of the Indian Penal Code and Section 3 / 4 of the Prevention of Witch Practices Act.

Allegation against all the petitioners is of assaulting informant and terming her to be witch and they also made attempt to burn her.

It is submitted on behalf of the petitioners that they have got no criminal antecedent. Petitioner nos. 1 and 2 are Bhaisurs of the informant and petitioner no. 3 is Gotni of the informant. The present case has been filed due to property dispute within the family. All the offences are bailable except for the provision relating to Section 3 of the Prevention of Witch Practices Act. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the

Patna High Court Cr.Misc. No.8247 of 2016 (2) dt.09-03-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Sathi P.S. Case no. 207 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
