JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This is an application for grant of anticipatory bail in connection with Excise Case No. 14-C2 of 2009, disclosing offence under Section 47(a, f) of the Bihar Excise Act. As per prosecution report, 15 liters of liquor and other articles were recovered from a Hut, which is situated outside the village and petitioner has been made accused in this case. Submission of the learned counsel for the petitioner is that prosecution report itself shows that recovery is from the outside of the village and nothing has been mentioned that same has been recovered from his house or from his possession. Prosecution case further disclosed that liquor was kept in the earth and the same was destroyed while recovering the same. Further submission is that he has no criminal antecedent. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge (Excise), Lakhisarai, in connection with Excise Case No. 14-C2 of 2009, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
