Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Dumraon P.S. Case No. 375 of 2022 lodged under Sections 341, 323, 307, 379, 504, 506, 34 of the I.P.C.

As per the prosecution case, 4 named persons were made accused in this case. There is a general and omnibus allegation to assault the informant and his son by lathi and iron rod against all the 4 accused persons. The specific allegation against the petitioner is that he has snatched Rs.5,000/- from the pocket of the son of the informant and threatened to kill him. It has also been narrated that the cause of dispute is land dispute which is pending.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.62831 of 2022(2) dt.25-02-2023 2/2 petitioner is innocent and has committed no offence. The specific allegation is only to snatch Rs.5,000/- from the pocket of the informant's son. Counsel further submits that for the same date and place of occurrence, there is one another case filed by the petitioner itself against the informant and others. The said case is Annexure-2 that is to say there are case and counter case that is Dumraon P.S. Case No. 375 of 2022 and Dumraon P.S. Case No. 376 of 2022. The land dispute between the parties are admitted. Counsel submits that antecedent of the petitioner is clean and he is in custody since 25.08.2022.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Dumraon P.S. Case No. 375 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
