Petitioner apprehends arrest in connection with Excise Case No. 90 C 2 of 2009 registered for the offence punishable under sections 47(a)(f) of the Bihar Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely on basis of suspicion. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the seized article. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.63158 of 2019(2) dt.18-10-2019 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand2019) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise, Lakhisarai in connection with Excise Case No. 90 C 2 of 2009 subject to the conditions laid down under section 438(2) Cr.P.C.
