Patna High Court CWJC No.17105 of 2022(2) dt.20-06-2023 2/3 and set-aside arbitrary and malafide order issued vide Encroachment Case no. 26/22-23 dated 29.9.22 by respondent authority the Circle Officer- Kusheshwarsthan, Darbhanga.

(ii) For issue an appropriate writ or order/orders/ direction/ directions in the nature of Mandamus commanding the State respondent Authorities directing them for stay the demolition petitioner's ancestral dwelling houses and could not forcibly demolition, dispossess and vacate of the petitioner ancestral dwelling houses.

(iii) To issue an appropriate writ preferable in the nature of mandamus commanding upon the respondent authorities to prevent illegal act."

After some arguments, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the Circle Officer, Kusheshwarasthan, Darbhanga, for filing their objections/reply to the notice issued under Section 3 of the Bihar Public Land Encroachment Act, 1956 in connection

The writ petition stands disposed off.
