Petitioner seeks bail in a case registered for the offences punishable under Sections 399,402,307,120B,414/34 of the Indian Penal Code and 25(1-b),a, 27,35 of the Arms Act. Petitioner is in custody since 08.08.2018. Allegation is that a loaded pistol and cartridges were recovered from possession of the petitioner. When the petitioner and others were apprehended on suspicion. They were preparing to commit dacoity.

Submission is that co-accused-Pintu @ Prusottam @ Pahalwan @ Prusottam Kumar has already been allowed bail by a Coordinate Bench of this Court vide Annexure-2.

No.60266 of 2019(2) dt.30-09-2019 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rajapakar Police Station Case No.136 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall remain present during trial on each and every date unless reasonable excuse is there till framing of the charge, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
