====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 10-12-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 386, 387/34 of the Indian Penal Code, Sections 25(1-b)a, 25(1-A), 25(1-AA), 25(1-AAA), 26(2), 27(2), 35 of the Arms Act, Sections 17, 18, 20, 22 and 23 of the U.P.A. Act.

Some other co-accused were apprehended on suspicion that they had assembled to accounts and distributes the levy collected by the criminal associates. They disclosed name of the petitioner as co-culprit.

Submission is that the persons arrested by the police have already been allowed bail in this case. There is no chance of tampering with the evidence. Investigation of the case is already complete against the petitioner.

No.61326 of 2019(3) dt.10-12-2019 2/2 Considering the aforesaid factual position, let the petitioner above named, who is in custody since 01.04.2019, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Saraiya Police Station Case No. 227 of 2016, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
