2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The Petitioner is apprehending his arrest in a case in connection with Laheri P.S. Case No. 292 of 2023 dated 12.05.2023 registered for the offences punishable u/ss 419, 420, 467, 468, 471, 379 and 120B read with section 34 of the Indian Penal Code and section 66(C), 66(D) of Information and Technology Act.

4. As per the prosecution case, on secret informant, police apprehended two accused persons with an Apache

No.68186 of 2023(2) dt.31-10-2023 2/3 Motorcycle who were trying to withdraw cash from the H.D.F.C., A.T.M. in suspected condition and on search, police recovered nine ATM cards, three mobiles, one page of bank account and Rs. 9,000/- in cash from Rahul Kumar and three ATM cards, one mobile and Rs. 2300/- were recovered from Vishnu Kumar.

5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has surfaced on the basis of the owner of the seized motorcycle. The petitioner has no criminal antecedent as stated at para 3 of the bail petition.

6. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.

7. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Nalanda at Biharsharif in connection with Laheri P.S. Case No. 292 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
